Section 377 of the Indian Penal Code, 1861, introduced during British rule in India (modeled on the Buggery Act of 1533), criminalizes sexual activities against the order of nature, including homosexual sexual activities.

In July 2009, the section was decriminalised by the Delhi High Court with regard to sex between consenting adults. This ruling was overturned by the Supreme Court of India on December 11, 2013. The court ruled that amending or repealing Section 377 should be a matter for Parliament and not the judiciary.

On August 24, 2017, the Supreme Court ruled that the right to equality is a fundamental right enshrined in the Constitution, called for equality and condemned discrimination, found that the protection of sexual orientation is a central part of fundamental rights, and that the rights of the LGBT population are real and enshrined in constitutional doctrine.
