Joe Biden's Senate records case is back in the spotlight. Here's what's happening

Wilmington, DE – The Daily Caller News Foundation (DCNF) and Judicial Watch have asked a Delaware court to reopen their case and demand the release of President Joe Biden’s Senate records held at the University of Delaware.

This request follows findings in Special Counsel Robert Hur's February report, which contradicted the University of Delaware's earlier claims that no taxpayer money was used to process the records sought by DCNF and Judicial Watch. In July, the Delaware Supreme Court ruled in favor of the university and blocked the release of those documents.

“The Hur report's stunning revelations go beyond the president's memory lapses and mental state,” said Michael Bastasch, DCNF editor-in-chief. “The court must reopen this case to determine whether the University of Delaware lied.”

Judicial Watch originally filed the lawsuit in July 2020 on behalf of itself and the DCNF after the university denied its request for the records on the grounds that they had no connection to the spending of public funds.

The documents sought include agreements to store 1,850 boxes and 415 gigabytes of records from Biden's Senate career from 1973 to 2009, communications between the university and Biden's staff, log sheets from visitors to the collection, and the actual collection records.

The motion filed by DCNF and Judicial Watch in the Delaware Supreme Court alleges that the Hur report shows that President Biden directed his former staff to review and catalog the Senate documents, with the university covering the costs. The motion argues that, contrary to previous representations by the university, such payments constitute quid pro quo on Biden's behalf.

Biden's records have been kept at the University of Delaware since 2012, with the condition that they will not be made publicly available until they have been properly processed and archived, according to the university's website.
