Fort Wayne man fails to appear for sentencing in 2021 rape case, arrest warrant issued

FORT WAYNE, Ind. (WPTA) – An arrest warrant was issued Monday for a 22-year-old Fort Wayne man who failed to appear for his sentencing in a 2021 rape case.

Jacob Miller was set to be sentenced to three years in prison for rape under a settlement offer if Allen Superior Court Judge David Zent approved the agreement, but he failed to show up for his 8:30 a.m. hearing.

He was tracked down and arrested on Monday afternoon.

Charges were filed against Miller and 23-year-old Joseph Hartman after an examination of the victim found DNA evidence that could be linked to both men.

According to court documents, the victim told police that she had been drinking at a party the night of the attack and passed out.

When she woke up, there were signs that she had been sexually abused.

Hartman is scheduled to be sentenced next month under a similar agreement.
