The mother of a 14-year-old who was shot and killed after a high school football game in Roxborough is suing the Philadelphia school district in federal court.

Nicolas Elizalde was one of several teenagers shot and killed outside Roxborough High School in September 2022.

He and four other victims were attacked by five gunmen. The other young people who were shot survived.

Elizalde was not the intended target.

His mother, Meredith Elizalde, filed a civil rights lawsuit in federal court against the Philadelphia school district on Tuesday, according to the law firm Kline & Specter.

The law firm stated that there were no security, police or school district personnel present in the area where the shooting occurred.

The lawsuit alleges that the district “organized extracurricular sporting events without adequate security measures and without coordination with law enforcement, based on policies, practices and inadequate training processes that were deliberately indifferent to the serious threat of gun violence at these events.”
