Home Depot agrees to $2 million settlement over excessive fees

Home Depot has agreed to pay nearly $2 million to settle allegations that it overcharged customers and mispriced items, it was announced Thursday.

The settlement follows a civil lawsuit filed by the district attorneys of San Diego, Alameda, Los Angeles, Orange, San Bernardino and Sonoma counties.

Prosecutors allege that Home Depot customers were charged higher than the posted prices for their items due to so-called “scanner violations,” which are prices displayed on shelves for items that change when the items are scanned at checkout.

Home Depot agreed to the settlement without admission of liability or wrongdoing.

As part of the agreement, the company will pay $1.7 million in civil penalties, as well as $277,251 to cover prosecutors' investigative costs and to fund other consumer protection efforts. Home Depot will also implement new price accuracy procedures that eliminate weekend price increases and implement audits and training on state price accuracy requirements.
