Second man charged in August 5 shooting

Evanston police have charged a second man in connection with the August 5 shooting on Dempster Street

Christopher Davis, 38, was charged with aggravated unlawful use of a weapon.

According to police, he drove away from the scene in the 1700 block of Dempster Avenue with a firearm that police say was used in the shooting, although he did not fire the weapon himself.

Commander Ryan Glew said Evanston police stopped Davis near the crime scene and discovered a gun on the floor of his car.

Glew says the Smith M&P 9mm found in the car matches the description of the rifle used in the shooting, which Davis was holding after the shooting.

According to police, Davis, who lives in the 8700 block of South Jeffery Boulevard in Chicago, did not have a gun license or a permit to carry a concealed weapon.

One of the men shot in the incident, 41-year-old Sean Gayle, remains in hospital custody, his lawyer said in court on Wednesday.

Gayle was charged with aggravated unlawful possession of a firearm and is scheduled to appear in court later this month after his release from hospital.

Glew said Gayle and the second man, a 50-year-old Evanston resident, shot each other during an ongoing argument.

Glew said the investigation into the incident is ongoing.
