Appeal court continues case over rape in residential home

LEXINGTON, Ky. (WKYT) – A Title IX lawsuit regarding the University of Kentucky's handling of a rape in a dorm room continues despite its first dismissal in 2022.

According to court documents, the victim, identified as Jane Doe, accuses University of Kentucky Police Chief Joe Monroe of preventing a police officer from testifying against a student at a disciplinary hearing.

Doe asked the officer to testify.

In the first three hearings, the panel sided with Doe, but the decisions were overturned on procedural grounds.

At a fourth hearing, the panel acquitted the man accused of rape.

Doe sued the university in 2015 for “willful indifference” under Title IX, but the suit was dismissed at the university’s request.

The U.S. Court of Appeals for the Sixth Circuit reinstated the case, finding that the district court's decision to dismiss the case in 2022 contained several errors.

The case has now been assigned to a new district judge.
