Waco man not charged in fatal gun attack in May

WACO, Texas (KWTX) – A McLennan County grand jury on Thursday acquitted a convicted felon of shooting another man to death in May in an apparent case of self-defense.

The grand jury did not indict 45-year-old David Rudy Monroe in the May 19 shooting death of 47-year-old Darrell Scott Davis. While jurors acquitted Monroe of murder, they also did not indict him on a second count of illegal possession of a firearm by a felon, apparently ruling that Monroe's claim of self-defense overrode the gun charge.

Monroe was never arrested in connection with Davis' death, and Waco police presented the case to prosecutors as a screening case. Prosecutors presented the case to the grand jury on Thursday.

Witnesses reportedly heard Davis, also a convicted felon, threatening to kill Monroe several times that night, and at least one saw him with a gun.

After the argument, Davis followed Monroe in his car. At about 3 a.m., Davis jumped out of his car to confront Monroe at the corner of New Road and Waco Drive with a rag wrapped around something in his hand. Monroe claimed he shot Davis in self-defense.

According to court records, Monroe was sentenced to seven years in prison for cocaine possession in 2000.
