According to the indictment, the first count alleges that Colley committed murder by repeatedly striking and kicking Shepherd in the head and body.

The second count states that Colley tampered with evidence.

“He believed that in an official proceeding, clothing would be presented or used that had been destroyed, mutilated, concealed, removed or altered when the defendant concealed the clothing he was wearing at the time of the murder,” the indictment states.

The third count states that Colley attempted to destroy, mutilate, conceal, remove or alter evidence that could be used in an official legal proceeding when he attempted to hide a blood-stained mirror at the crime scene.

The fourth count states that when Colley removed Shepherd's body after his death, he attempted to alter, remove, conceal, mutilate or destroy evidence that could be presented or used in an official legal proceeding.
