FBI shoots murderer of 14-year-old boy, triggering 33-year-old unsolved case

A 14-year-old California boy killed 33 years ago was murdered by a man who was shot and killed by the FBI in 2007 while living under a different name in Ohio, authorities said Tuesday.

Teenager Raymond Ojeda was shot and killed in the Foxdale Loop neighborhood of San Jose on September 28, 1991, according to the Santa Clara County District Attorney's Office.

His killer, then 15-year-old Gerardo Aguilar, was identified by police and an arrest warrant was issued for him, but before he could be caught he “disappeared,” officials said.

Earlier this year, the state attorney general's cold case unit identified an Ohio resident named Gerardo Mulato, a now deceased man, as a possible match for Aguilar.

Gerardo Aguilar
Gerardo Aguilar shot and killed a 14-year-old boy in 1991 when he was just 15 years old.

SCCDAO investigator John Cary followed up on a “hunch,” conducted background research and discovered that Aguilar’s sister’s last name was Mulato.

He found photos of a man in Forest Park outside Cincinnati “who looked very similar to the suspect” and went by the name “Gerardo Mulato.”

Gerardo Aguilar
Gerardo Aguilar lived in Ohio under a false name for years.

“DNA analysis confirmed that it was the same person. Aguilar had lived in Ohio for several years under the (surname) Mulato,” prosecutors wrote.

Aguilar's criminal activities continued after he fled California.

He was arrested in 2004 under the name Mulato for assault with a baseball bat in Springfield, Ohio, officials said.

In 2007, the FBI began investigating Aguilar for drug trafficking.

Aguilar saw the FBI installing a tracking device on his car and pulled out a gun because he thought they were car thieves.

An agent fatally shot him. Aguilar was 33 years old.

“It is never too late to identify a killer,” District Attorney Jeff Rosen said in a statement.

“Maybe people forget. But the families of the victims and my office will not forget.”
