TVPA case against Abercrombie and Family Office not dismissed despite EDNY subpoena

SDNY CourthouseAugust 23 – Abercombie & Fitch, the Jefferies Family Office and two individuals were sued under the Trafficking Victims Protection Act by a model who claimed he was told that if he did not submit to coercion for sex, he would not be able to get the modeling job and career.

On August 23, Judge Jennifer H. Rearden of the U.S. District Court for the Southern District of New York held a hearing denying the defendants' motion to stay proceedings in light of an EDNY subpoena, Inner City Press reported. Thread:

The SDNY judge reads her ruling on the defendants' motion to stay proceedings against them based on a criminal subpoena from the EDNY.

Judge: There is nothing here to indicate that the plaintiff was ever informed by the government of the impending investigation. The plaintiff was interviewed by the FBI but was given no further information. He was not informed under the TVPA – nothing in writing

Judge: The defendants' application for a stay is therefore denied without prejudice. If they come into possession of further information they may make a new application. This is the order of the court. I will issue a notice of an IPTC. Adjournment.

The case is Bradberry v. Abercrombie & Fitch Co., et al., 23-cv-9440 (Rearden).
