The woman from Bengaluru claimed that her husband, who lives in the United States of America (USA), did not allow her to eat French fries, rice and meat

The Karnataka High Court has stayed the investigation into a case against a man who allegedly prevented his wife from eating chips after the birth of their child in the US. Justice M Nagaprasanna found the allegations against the man to be trivial and hence stayed the investigation.

In his ruling, the judge noted that continuing the investigation would be an abuse of law. “Allowing any investigation against the husband to proceed would be an abuse of law and would add weight to the wife's claims that she should not have eaten chips at the time in question. Therefore, an injunction should be issued suspending any investigation against the husband,” he said.

The woman's husband, who works in the US, was also allowed to return to work after he assured the court that he would cooperate with the investigating authorities and not evade the proceedings. The man requested a stay of the investigation on the grounds that the complaint was unfounded.

His lawyer pointed out that a Look Out Circular (LOC) was issued against him, prohibiting him from returning to the United States for employment, following his wife's complaint. The court had previously stayed the investigation against the man's parents, who were also named in the complaint. In her complaint, the woman alleged that her husband did not allow her to eat French fries, rice and meat soon after the birth of their child.

The husband countered that his wife had made him do all the household chores while she was in the US before the birth of the child. Justice Nagaprasanna criticised the application of the LOC in this case, terming it an abuse of the legal system. He concluded that the complaint appeared frivolous and allowed the husband to return to the US to perform his professional duties.
