Former police officer pleads guilty to driving under the influence of alcohol after accident in 2023

MUNCIE – A former Muncie police officer pleaded guilty Monday to driving under the influence following a July 2023 crash in Howard County.

Corey Posey reached a plea deal with the Howard County District Attorney's Office and pleaded guilty to operating a vehicle with a blood alcohol content of .08 or more but less than .15, a misdemeanor.

As part of the agreement, prosecutors dropped additional charges of driving under the influence and endangering a person.

As WRTV reported, Posey was arrested for drunk driving in July 2023 after he rear-ended another vehicle on US 31, according to Kokomo police, and a certified chemical test showed his blood alcohol content was .087, above the legal limit of .08.

At the time of the accident, Posey was employed as a police officer in Muncie.

Howard County Judge Douglas Tate sentenced Posey to 58 days probation.

Suspended sentences are often served on probation, and the judge may impose a prison or jail sentence if the defendant violates the terms of the probation.

Prosecutors recommended that Posey be placed on probation after completing an alcohol and drug rehabilitation program.

However, Howard County Judge Douglas Tate found that Posey had already fulfilled his probation requirements by completing the drug and alcohol program.

According to court documents, Posey's driver's license was also suspended for 60 days.

Posey was the fifth former Muncie police officer in the federal government's case against current and former Muncie police officers for police brutality or attempted cover-up.

He was found not guilty of false reporting.

Federal prosecutors mentioned Posey's drunken driving case in court documents while the false statements charge was still pending.

“Posey struck another vehicle and endangered the community through his conduct,” the U.S. Attorney's Office said in a motion. “It is also concerning that Posey felt the need to inform Officer Riley (Kokomo Police) on multiple occasions that he is currently an active detective with the Muncie Police Department.”

Posey remained on paid administrative leave from April 14, 2021, until August 3, 2023, when the Muncie Police Merit Commission placed him on unpaid leave.

Posey retired from the Muncie Police Department in October 2023.
