Jack Smith updates Trump's indictment in January 6 case

Special Counsel Jack Smith filed an updated indictment on Tuesday in his case against former President Donald Trump, alleging he attempted to overturn the 2020 election. The indictment was revised after the Supreme Court granted Trump some immunity from criminal charges – but Trump still faces four felonies.

Smith's updated indictment still charges Trump with conspiracy to defraud the United States, conspiracy to obstruct an official proceeding, obstruction of an official proceeding and conspiracy to violate rights – the same charges he was previously charged with – for his post-election efforts.

The Supreme Court ruled in July that Trump could not be prosecuted for his “official acts” as president. What that means in practice, however, remained vague. It largely left it up to U.S. District Judge Tanya Chutkan to determine what in the indictment against Trump was not part of his official duties and could therefore be prosecuted.
