Man allegedly drove drunk onto the terrace of the Park Tavern, killing two people and injuring nine

Hennepin County District Attorney Mary Moriarty announced charges Tuesday against a man who allegedly drove his car into the patio of the Park Tavern in St. Louis Park on Sunday evening, killing two people.

56-year-old Steven Frane Bailey was arrested in connection with the accident.

Moriarty said Tuesday that Bailey's preliminary blood alcohol content at the time of the crash was .325 – more than four times the legal limit – as determined by a breath test. A blood draw was also performed, according to court documents, and results are pending.

On Tuesday, he was charged with two counts of negligent homicide and nine counts of negligent negligence.

Two people were killed in the crash. They were identified Monday as Gabe Harvey, a Methodist intensive care coordinator, and Kristina Folkerts, a Park Tavern employee.

While police initially said there were three injured, Moriarty confirmed Tuesday that nine people were injured. She said more charges could be filed if more victims are found or come forward. If you were injured but did not report it, you are asked to contact St. Louis police.

Methodist Hospital confirmed that four of the injured people were nurses who worked there.

The accusation

As previously reported, St. Louis police were called to Park Tavern on Sunday because a vehicle drove through the patio and hit several people.

Bailey was still in the vehicle and was the only person inside.

According to a criminal complaint, Folkerts was trapped under the car. Despite first aid, she died at the scene of the accident.

Several other people received medical attention from other guests in the restaurant.

As officers approached the car, they heard Bailey saying on the phone, “I hit the gas instead of the brake and drove right through something” and “I'm probably going to go to jail,” court documents say.

Bailey's speech was slurred, and his eyes were watery and bloodshot. During a breathalyzer test, officers found six indicators that Bailey was intoxicated. They did not conduct further tests because Bailey claimed he had had surgery on his legs.

After being medically examined at the hospital, Bailey was taken to jail. When told he was being arrested for involuntary manslaughter, he reportedly said, “You can't be serious,” and “My life is pretty shitty now, isn't it?”

Court documents also state that Harvey was taken to the hospital where he was pronounced dead.

Other injuries include:

  • One woman suffered a broken leg, fractured pelvis, broken ribs and dislocated knees. She is still unconscious and intubated, according to court documents.
  • One victim suffered a head trauma and lost consciousness on the way to the hospital
  • A man suffered a traumatic brain injury and cuts to his face and completely lost his memory regarding the accident and the events prior to his hospitalization.
  • Several others suffered minor injuries and bruises

Court records show that Bailey has been convicted of drunk driving five times and has had his license revoked multiple times.

Bailey's first court appearance is scheduled for Wednesday afternoon. Moriarty said her office is requesting bail of $1 million.
